TERMS OF SALE

Terms of sale

1.GENERAL INFORMATION

These conditions of sale, which cancel and replace all previous ones, apply to all orders processed by us and are deemed fully accepted by the buyer upon placing an order, whether written or verbal. Collection of the goods constitutes implicit order confirmation.

2.PRODUCTS

Small changes in the production and presentation of the product, which do not alter its characteristics of use, may be made by our Company without notice and cannot be invoked by the buyer as a reason for cancelling the order.

3.PRICES

All prices indicated in our price lists are "Ex Works Loc. Pratantico, Arezzo (AR) Italy", excluding VAT, unless otherwise indicated in the offer.

4.PACKAGING

Standard packaging is included in the price of the goods; special packaging, if necessary, will be charged at cost.

5.TRANSPORT

In cases where the shipping method is not explicitly specified by the Customer, shipment will be made using the method we deem most appropriate, with payment being borne by the buyer.

Shipping costs and delivery times will be communicated by email based on the items selected.

Upon shipment, the tracking number will be sent via email, allowing you to track your shipment.

6.DELIVERIES

Delivery times are not binding, but only indicative.

The buyer releases the seller from any and all liability for damages resulting from delays in delivery of goods.

Delays in delivery for specially produced special pieces cannot be grounds for order cancellation.

7.WARRANTY

Our products are guaranteed against defects in materials or workmanship attributable to us for a minimum period equal to that established by current European regulations.

The warranty is void if:

a) the product has been used outside the operating conditions specified by us;

b) the material has been modified or tampered with in any way by anyone not authorized by our company.

The warranty is limited to the repair or replacement of defective products, with the absolute exclusion of any liability arising from damage caused by the use of our products.

N.B.: In the event of repair or replacement at our premises, the customer will be responsible for the shipping costs.

8.COMPLAINTS

Any complaints must be made within 8 days of the date of delivery of the goods.

9.RETURNS

All returns must be authorized in advance by our sales office and will be accepted only if accompanied by the sales documents (number and date of the packing slip and the corresponding invoice).

Returns without the tracking number will not be accepted.

All returns must be made carriage paid.

10.RIGHT OF WITHDRAWAL

1. Distance Selling (Online Form, Email, WhatsApp, Telephone)

Pursuant to the Consumer Code and the Civil Code, the rules governing withdrawal vary based on the nature of the buyer:
1.1 Consumer Customer (B2C): Customers purchasing for purposes other than their professional activity have the right to withdraw from the contract within 14 days of receiving the goods, without having to provide any reason. The customer must then return the goods within fourteen days of the notification of withdrawal.
Exclusion: The right of withdrawal is excluded for the supply of goods made to measure or clearly personalized (Art. 59, letter c, Consumer Code).
Method: To exercise the right of withdrawal, the Customer must send written notification via email or certified email within the aforementioned deadline. Return costs are borne by the Customer.
1.2 Professional/Business Customer (B2B): For purchases made with a VAT number, the right of withdrawal (cooling off) is not provided. The contract is considered final once the order is confirmed. Any complaints regarding defects in the goods must be notified within 8 days of delivery pursuant to Art. 1495 of the Italian Civil Code.

2. Sales at the Physical Commercial Headquarters
For purchases completed by placing an order and/or making payment at the Company's operational headquarters:
2.1 No Right of Withdrawal: Since these are contracts concluded on commercial premises, the right of withdrawal does not apply to either B2C or B2B customers. The sale is considered final upon purchase or reservation on-site.
2.2 Made-to-Order Products: For products ordered on-site that require subsequent production (standard or customized), the Customer pays a Confirmation Deposit (Art. 1385 of the Italian Civil Code). In the event of default by the Customer (failure to pay or refusal of the goods), the Company will retain the entire deposit as compensation for damages and production costs incurred.

3. General Provisions for Customized Goods
Regardless of the place of purchase (online or in-store), for all products made to the Customer's technical or aesthetic specifications, the right of withdrawal is reiterated. In such cases, the amount paid upon order (Confirmatory Deposit) serves to cover the costs of materials and workmanship undertaken exclusively for the Customer.

11.PAYMENTS

Payments must be made to MJ FABER by Jommi Massimiliano.

Unless otherwise specified in the offer, the payment methods are as follows:

12.RESERVED DOMAIN

The goods remain the property of the seller MJ FABER di Jommi Massimiliano until full payment has been made for the same, as well as for any sums due for transport, insurance, etc.

13.CONTROVERSIES

For any dispute, the Court of Arezzo shall have exclusive jurisdiction.

14.RIGHT TO PRIVACY

Pursuant to Legislative Decree No. 196/2003, by completing the order form (email or fax) or submitting personal information, the customer authorizes MJ FABER di Jommi Massimiliano to process their personal data. The aforementioned data will be used only by MJ FABER di Jommi Massimiliano, which may use it to send informational and promotional materials strictly related to the site.

Pursuant to Article 13 of Legislative Decree No. 196/2003, the customer has the right to access their data and the right to request, at any time, its deletion, anonymization, blocking of data processed in violation of the law, and its updating, rectification, and integration.
